Acceptance of Terms

Welcome to Shop Livvi LLC’s Terms of Service agreement! For purposes of this agreement, “Site” refers to the Company’s website, which can be accessed at Home – Shop Livvi. “Service” refers to the Company’s services accessed via the Site, in which users can buy, sell, and browse products on ShopLivvi.com. The terms “we,” “us,” and “our” refer to the Company. “You” refers to you, as a user of our Site or our Service. 

 

The following Terms of Use apply when you view or use the Service via our website located at Home – Shop Livvi. Shop Livvi LLC reserves the right to update or modify these terms at our discretion. All changes are effective immediately when we post them and apply to all access to and uses of the Services. You understand and agree that your continued access to or use of the Services after the effective date of changes to the Terms represent your acceptance of such changes. 

 

Please read these Terms carefully before you start to use the Services. IF you do not agree to these Terms, you must not access or use the Services. These Terms apply to all users of the Services, including without limitation, users who are sellers, buyers, or browsers. 

 

By using our Service, you are creating a legally binding contract to comply with all the terms.

 

Privacy Policy

The Company respects the privacy of its Service users. Please refer to the Company’s Privacy Policy: Livvi Privacy Policy – Shop Livvi. This policy explains how we collect, use, and disclose information that pertains to your privacy. When you access or use the Service, you signify your agreement to the Privacy Policy as well as these Terms of Service. 

 

Registration; Rules for User Conduct and Use of ShopLivvi.com

You need to be at least 18 years old and a resident of the United States to register for and use the Service. If you are a user who signs up for the Service, you will create a personalized account which includes a unique username and a password. You agree to notify us immediately of any unauthorized use of your password and/or account. Shop Livvi will not be responsible for any liabilities, losses, or damages arising out of the unauthorized use of your member name, password, and/or account. When you are purchasing a product from a Shop Livvi seller, you must adhere to that Seller’s Terms of Service. In the same vein, Sellers must adhere to their own Terms of Service. 

 

Shop Livvi Subscription Policy

  • The monthly Shop Livvi Seller Subscription must be paid in full to sell products on a Seller’s store.
  • Shop Livvi reserves the right to increase or decrease the subscription price and frequency as the platform grows and evolves.
  • Shop Livvi reserves the right to cancel your Shop Livvi seller subscription if, in Shop Livvi’s sole judgment, you fail (or Shop Livvi suspects that you have failed) to comply with any term or provision of these Terms of Service. 
  • Shop Livvi reserves the right to temporarily pause or cancel subscriptions in order to perform scheduled maintenance or enhancements to the site. 
  • Shop Livvi may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to (and including) the date of termination.

 

Seller Policies

Shop Livvi is a marketplace and community that is passionate about the success and growth of America-First, Pro-Life, Pro-Family Values, Pro-Constitution businesses. To provide the best experience possible for our sellers and your customers, here is a list of some seller guidelines that must be agreed to when accessing the Service. 

 

  1. What can be sold on Shop Livvi?
    1. Anything a creator/entrepreneur would create and sell that can be legally created/sold/owned based on your region’s, state’s, county’s, and country’s laws that do not violate Shop Livvi’s values. 
    2. An item(s) that is illegal to create/sell/own in your place of business or customer’s shipping address cannot be sold on ShopLivvi.com
      1. If an illegal item is reported to Shop Livvi or discovered on the Company’s site, Shop Livvi holds the right to immediately remove the item in question. 
    3. Shop Livvi is a platform that enthusiastically encourages the empowerment and freedom necessary to create and run a successful store. 
      1. We politely ask for your cooperation in only posting products/services that are legal and match Shop Livvi’s values in order for our growing community to thrive. 
      2. We ask that each item is accurately named and described for the benefit of your customers. 
      3. If you are selling goods that are not created by you, you must disclose the manufacturer and the country where the manufacturing is taking place. 
      4. If you are selling art that is not created by you, you must disclose that you are not the original creator. 
        1. This information is to be listed in your product’s description on the product page, and you must credit and or have permission to sell it from the original author.
  2. What cannot be sold on Shop Livvi?
    1. An item(s) that is illegal or to create/sell/own in your place of business or customer’s shipping address.
      1. This applies to products that do not comply with the values of Shop Livvi.
      2. Products that are to be shipped to countries that are prohibited by OFAC’s SDN list
      3. If an illegal item is reported to Shop Livvi or discovered on the Company’s site, Shop Livvi holds the right to immediately remove the item in question. 
      4. Art/products not owned by you that you do not have written permission from the IP owner to sell.
      5. If you are raising money for or on behalf of a charity, you must have that charity’s consent.
  3. How to maintain your Shop Livvi store.
    1. Ensure that your products and store are representative of Shop Livvi’s values.
    2. Ensure that your products and store accurately represent what you are selling.
    3. To the best of your ability, provide accurate information about yourself in your Seller Bio.
    4. To the best of your ability, source as many products and goods to sell from your store that are Made in the USA.
    5. Honor your store’s Returns and Warranty Policy
      1. Shop Livvi does not force sellers to set a Returns and Warranty Policy
      2. However, if you do set a Returns and Warranty Policy, Shop Livvi asks that you honor it to the absolute best of your ability. 
        1. If you need help establishing your Returns and Warranty Policy, Shop Livvi team members are more than willing to help.
        2. Message us at our Support Center page, and we’ll answer your inquiries to the best of our abilities!
    6. Please do:
      1. Accurately represent your products in your pictures.
      2. Do not engage in fee avoidance.
      3. Obey any and all local, state, and federal laws pertaining to business or personal taxes.
      4. Have fun engaging with your like-minded customers as you and your store grow in this alternative economy!

 

General Site Restrictions

Shop Livvi holds the right to temporarily or permanently suspend and/or delete your account, products, and store if a store owner and/or staff participates in any of the following actions listed below:

  • Distribute any part or parts of the Site or Service without our explicit written permission (we grant the operators of public search engines permission to use spiders to copy materials from the site for the sole purpose of creating publicly-available searchable indices, but retain the right to revoke this permission at any time on a general or specific basis). 
  • Use the Service for any unlawful purpose or for the promotion of illegal activities. 
  • Attempt to, or harass, abuse, or harm another person or group.
  • Go against Shop Livvi’s values
  • Provide false or inaccurate information when registering an account.
  • Interfere or attempt to interfere with the proper functioning of the Service.
  • Make any automated use of the Site, the Service, or the related systems, or take any action that we deem to impose or to potentially impose an unreasonable or disproportionately large load on our servers or network infrastructure. 
  • Bypass any robot exclusion headers or other measures we take to restrict access to the Service, or use any software, technology, or device to scrape, spider, or crawl the Service, or harvest/manipulate data. 
  • Circumvent, disable, or otherwise interfere with any security-related features of the Service or features that prevent or restrict use of copying of content, or enforce limitations on use of the Service or the content accessible via the Service.
  • Publish or link to malicious content of any sort, including that intended to damage or disrupt another user’s browser or computer. 

 

To ensure that Shop Livvi restrictions and Terms of Service are followed and that Shop Livvi’s community is one that thrives, the Company reserves the right to monitor buyers, sellers, and browsers on the website. Shop Livvi will never sell buyer, seller, and browser information to third parties. 

 

Anti-Money Laundering Program

In order to help combat the issue of money laundering, Shop Livvi reserves the right to contact a seller’s bank/financial institution to verify that the financial institution listed in their Shop Livvi account is the actual bank they, the seller, has an account with. Shop Livvi LLC nor any affiliates will ever sell this bank information. 

 

Copyright/IP Infringement and Claims Process

Termination of Repeat Infringer Accounts

  • We respect the intellectual property rights of others and require that users do the same. Pursuant to 17 U.S.C. 512(i) of the United States Copyright Act, we have adopted and implemented a policy that provides for the termination in appropriate circumstances of users of the Service who are repeat infringers. Shop Livvi holds the right to terminate access of the Service for users who are found repeatedly to provide or post protected third party content without necessary rights and permissions. 

DMCA Take-Down Notices

  • If you are a copyright owner or an agent thereof and believe, in good faith, that any materials provided on the Service infringe upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act (see 17 U.S.C. 512) (“DMCA”) by sending the following information to our Shop Livvi Support email at Support@ShopLivvi.com:
    • The date of your notification
    • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed
    • A description of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site
    • A description of the material that is claimed to be infringing or to be the subject of infringing activity and information sufficient to enable use to locate such work
    • Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and/or email address
    • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
    • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. 
  • You may also notify Shop Livvi admin about the IP infringement via the Report Abuse button found on each product listing. 

Counter-Notices

    • If you believe that your User Content that has been removed from the Site is not infringing, or that you have the authorization from the copyright/IP owner, the copyright owner’s agent or pursuant to the law, to post and use the content in your User Content, you may send a counter-notice containing the following information to our support email at Support@ShopLivvi.com:
      • Your physical or electronic signature
      • A description of the content that has been removed and the location at which the content appeared before it was removed
      • A statement that you have a good faith belief that the content was removed as a result of mistake or a misidentification of the content
      • Your name, address, telephone number, and email address, a statement that you consent to the jurisdiction of the federal court in the state of Texas, and a statement that you will accept service of process from the person who provided notification of the alleged infringement
    • If a counter-notice is received by Shop Livvi admin, we may send a copy of the counter-notice to the original complaining party informing such person that it may reinstate the removed content in seven (7) business days. Unless the copyright owner files an action seeking a court order against the content provider or user, the removed content may (in Shop Livvi’s sole discretion) be reinstated on the Site in ten (10) to fourteen (14) business days or more after the receipt of the counter-notice. 
  • In order to avoid these hurdles, we at Shop Livvi ask that all sellers take special care to not sell copyrighted material. 
    • If you think the product(s) you are selling may be copyrighted, we highly recommend you perform a copyright search with the US Copyright Office. Their site can be accessed here.

 

Intellectual Property

You acknowledge and agree that we and our licensors retain ownership of all intellectual property rights of any kind related to the Service, including applicable copyrights, trademarks, and other proprietary rights. Other product and company names that are mentioned on the Service may be trademarks of their respective owners. We reserve all rights that are not expressly granted to you under these Terms of Service. 

 

Any intellectual properties, trademarks, or copyrights that are owned by you cannot be used by Shop Livvi for marketing, advertising, or promotional material without your consent. 

 

Limitation of Damages; Release

To the extent permitted by applicable law, in no event shall the Site, the Service, its affiliates, directors, or employees, or its licensors or partners be liable to you for any loss of profits, use, or data, or for any incidental, indirect, special, consequential, or exemplary damages, however arising, that result from: (a) the use, disclosure, or display of your user content; (b) your use or inability to use the service; (c) the service generally or the software or systems that make the service available; or (d) any other interactions with use or with any other user of the service, whether based on warranty, contract, tort (including negligence) or any other legal theory, and whether or not we have been informed of the possibility of such damage, and even if a remedy set for herein is found to have failed of its essential purpose. Some jurisdictions limit or do not permit disclaimers of liability, so this provision may not apply to you.

What can be sold on Shop Livvi?

  • Anything an artist/entrepreneur would create and sell that can be legally created/sold/owned based on your region’s, state’s, county’s, and country’s laws.
  • An item(s) that is illegal to create/sell/own in your place of business or customer’s shipping address cannot be sold on ShopLivvi.com.
  • If an illegal item is reported to Shop Livvi or discovered on the Company’s site, Shop Livvi holds the right to immediately remove the item in question. Shop Livvi is a platform that enthusiastically encourages the empowerment and freedom necessary to create and run a successful store.
  • We politely ask for your cooperation in only posting products/services that are legal in order for our growing community to thrive.
  • We also ask that each item is accurately named and described

If you are selling art that is not created by you, you must disclose that in that art piece’s product page description, and you must credit and or have permission to sell by the original author

What cannot be sold on Shop Livvi?

  • An item(s) that is illegal or to create/sell/own in your place of business or customer’s shipping address cannot be sold on ShopLivvi.com
  • This applies to products that are considered obscene.
  • Products that are to be shipped to countries that are prohibited by OFAC’s SDN list.
  • If an illegal item is reported to Shop Livvi or discovered on the Company’s site, Shop Livvi holds the right to immediately remove the item in question.
  • Shop Livvi also retains the right to temporarily or permanently disable your account for any violations. 
  • Art/product(s) that you do not have written permission from the IP owner to sell.
  • Products that have stock photos.
  • If you are raising money for or on behalf of a charity, you must have that charity’s consent. 
  • No gambling if prohibited in your state.

How to maintain your Shop Livvi store

TO THE EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE SITE, THE SERVICE, ITS AFFILIATES, DIRECTORS, OR EMPLOYEES, OR ITS LICENSORS OR PARTNERS, BE LIABLE TO YOU FOR ANY LOSS OF PROFITS, USE,  OR DATA, OR FOR ANY INCIDENTAL, INDIRECT, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, HOWEVER ARISING, THAT RESULT FROM: (A) THE USE, DISCLOSURE, OR DISPLAY OF YOUR USER CONTENT; (B) YOUR USE OR INABILITY TO USE THE SERVICE; (C) THE SERVICE GENERALLY OR THE SOFTWARE OR SYSTEMS THAT MAKE THE SERVICE AVAILABLE; OR (D) ANY OTHER INTERACTIONS WITH USE OR WITH ANY OTHER USER OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS LIMIT OR DO NOT PERMIT DISCLAIMERS OF LIABILITY, SO THIS PROVISION MAY NOT APPLY TO YOU.
